Infolexa, LLC ("Infolexa," "Skailet," "we," "us," or "our") has prepared this Privacy Policy to explain what Personal Data (defined below) we collect, how we use and share that data, and your choices concerning our data practices. Through our website (the "Site") and services provided by us (the "Services"), we offer various e-commerce solutions.  This Privacy Policy explains what Personal Data (defined below) we collect, how we use and share that data, and your choices concerning our  data practices. This Privacy Policy is referenced by our Terms of Service, which is also available on our website.  Before using the Site or Services or submitting any Personal Data to Infolexa, please review this Privacy Policy carefully and contact us if you have any questions. 


GDPR Compliance

If you are located in the European Union (EU) or the United Kingdom (UK), we process personal data in accordance with the applicable data protection laws, including:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, or “GDPR”), and
  • The UK GDPR and Data Protection Act 2018 for users in the United Kingdom.

As a Software-as-a-Service (SaaS) provider, we act primarily as a data processor on behalf of our customers, who determine the nature, scope, and purpose of the personal data processed through our platform. Our customers are considered the data controllers under GDPR.

The data processed via our platform may include pseudonymized personal data, depending on how our customers configure and use the service. We process such data solely in accordance with our customers’ instructions, as outlined in our Data Processing Agreement (DPA).

We are not required to appoint a Data Protection Officer (DPO) under Article 37 of the GDPR, as our core processing activities do not involve large-scale monitoring or processing of special categories of data.

We implement appropriate technical and organizational measures to safeguard personal data in compliance with Article 28 and other applicable provisions of the GDPR.


By using the Site or Services, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the Site or otherwise use the Services.


1. Personal Data We Collect

We collect information that alone or in combination with other information in our possession could be used to identify you ("Personal Data") as follows:


Personal Data You Provide:

  • Identity Data: Name, postal address, email address, telephone number, and account login credentials.
  • Transaction Data: Payment card details, billing address, and details about payments to and from you.
  • Profile Data: Your username and password, purchases or orders made by you, your interests, preferences, feedback, and survey responses.
  • Authentication Tokens: We collect and store authentication tokens from users for third-party API access and from third-party sign-in providers (Microsoft and Google) for users to sign-on using third-party credentials.


Data We Collect Automatically:

  • Usage Data: Information about how you use our Site and Services, including details of your browsing and purchasing patterns.
  • Device Data: Technical information, including the type of device you use, a unique device identifier (for example, IP address), operating system, and version. Information collected will depend on the type of  device and your settings.
  • Location Data: Your approximate location, as determined from your IP address.
  • Log Data: Information sent by your browser automatically when you visit the Site.  This information includes date and time of the request, internet protocol address, browser type and settings and how the user interacted with the Site.


Data From Third Parties: 

We may receive Personal Data about you from our business partners, payment providers, and other third parties.

  • Performance/Analytics Cookies: These cookies help us improve the sSite by tracking how you use it, like which pages you visit and how long you stay.


Personal Data We Process on Behalf of Business Customers:

We may also process Personal Data on behalf of our business customers who provide your access to our Service to interact with their own customers ("Business Customer Data"). This data is only processed in accordance with our Terms of Service and other agreements with applicable business customers.


2. How We Use Personal Data

We may use Personal Data for the following purposes:

Marketing:

We may reach out to you with information we think you’ll find useful or interesting. For example, if you provide us with your email address, we might send you promotional emails like a monthly newsletter. However, if you’re located in the EU (or other regions with similar laws), we will only send you marketing emails if you’ve given us permission to do so when you provide your Personal Data. You can always unsubscribe from our marketing emails by following the instructions in the email or contacting us directly. If you unsubscribe, you won’t receive marketing emails anymore, but we may still contact you about your account, our services, or to respond to any requests you’ve made.

  • Vendors and Service Providers: To help us operate our business and provide necessary services, we may share Personal Data with third-party vendors and service providers. These providers will access, process, or store personal data only as needed to perform their duties for us, based on our instructions. We take commercially reasonable steps to ensure that our service providers follow the security standards we apply to protect your Personal Data.
  • Vendor Specific Disclosures: We may share your Personal Data with the following vendors under specific terms: (1) We use Stripe for payments, analytics, and other business services. Stripe may collect personal data including via cookies and similar technologies. The personal data Stripe collects may include transactional data and identifying information about devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection, loss prevention, authentication, and analytics related to the performance of its services.   • Business Transfers: If our company goes through a major change, such as a merger, acquisition, or sale of assets, your Personal Data may be shared with others involved in that process (like potential buyers or legal advisors). Your data may also be transferred to the new company or organization that takes over our Services.
  • Legal Requirements: We may disclose your personal data if required by law or if we believe, in good faith, that it is necessary to: (i) comply with a legal obligation, including national security or law enforcement requirements; (ii) protect and defend our rights or property; (iii) prevent fraud; (iv) respond to urgent situations to protect the personal safety of users or the public; or (v) protect against legal liability.

We keep personal data for as long as needed to fulfill the purposes in this Privacy Policy, for our business needs, or as required by law (e.g., for tax or legal reasons), whichever is longer.

  • Know: You can request information about the categories of personal data we’ve collected, the purpose for collecting it, the sources from which it was collected, if we’ve shared your data for business purposes, the categories of data shared, and the third parties to whom we’ve shared it (we provide this above).
  • Access: You can request access to the specific personal data we have collected about you.
  • Delete: You can request that we delete your personal data and opt out. You can also instruct businesses that sell your data to stop doing so. Note, Infolexa does not sell personal data.


Other Rights (as applicable by jurisdiction): Depending on your location, you may also have additional rights, such as the right to restrict or object to processing, the right to data portability, and the right to lodge a complaint with the relevant supervisory authority.


If you wish to exercise any of these rights or request an alternative version of this Privacy Policy, please contact us by email or letter. We may ask for more information to verify your identity. If you’re using an authorized agent to submit the request, they may need to provide signed permission from you and may be required to verify your identity. We will not treat you differently for exercising these rights.


6. Children

Our service is not intended for children under 13. Infolexa does not knowingly collect personal data from children under 13. If you believe a child under 13 has shared personal data with us, please contact us, and we will endeavor to delete that information.


7. Security

You use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Data from loss, misuse, unauthorized access, disclosure, alteration, or destruction.


Please note that no Internet or data transmission is completely secure or error-free, including data sent to or from us. Be cautious about the information you send to us via the Service or email. We are not responsible for any bypassing of privacy settings or security measures on our Service or third-party websites.


8. International Users

By using our Site or Services, you understand that your Personal Data will be transferred to the United States.


9. Changes to the Privacy Policy

Our Service and business may change over time, and so may this Privacy Policy. When we update it, we’ll post the new version on this page, unless the law requires a different form of notice.
